Danish Gambling Authority
The major licensing activities that are related to gambling operations in Denmark are under the control of the state-owned entity known as Danske Spil, which has been in operation since 1948.
Denmark began a shift towards liberalizing the gambling market in 2008 through a legal challenge against DanskeSpil’s monopoly in the European Court of Justice. The Danish government thus began the arduous task of putting together a licensing and regulatory system in order to open its online gambling industry to other companies.
At present, all activities related to gambling within the state of Denmark are regulated, controlled, and monitored by the Danish Gambling Authority [DGA], a department that falls under the nation’s Ministry of Taxation. The DGA has also signed memorandums with the Alderney Gaming Commission as well as the Isle of Man which states that operators from any jurisdiction are allowed to apply for licensing but gambling operators will only be approved by the DGA.
Type of Licenses
The Danish Gambling Authority provides operators with two options for the online gaming licenses
- The betting license is issued to gaming operators who offer online sports betting.
- The online casino license is issued to operators who offer online gaming activities.
The gambling license which is applicable for both online and land-based casinos can also be expanded to include the state of Greenland. Upon approval, the license is valid for five years and the DGA won’t impose restrictions regarding the number of licenses.
The license for a land-based casino is valid for up to ten years but the DGA will impose restrictions regarding the number of land-based casinos an operator can run. The other licenses for land-based gambling are;
- A land-based gaming machine license that is valid for an unlimited period.
- A land-based poker license for offering public poker tournaments, whose validity is for a maximum of two years.
Application Requirements
Operators must provide adequate information based on a list that they can download on the DGA portal. This information ranges from a description of the gambling system to a list of the employees responsible for various aspects of the gaming business. Once all requirements have been met, applicants must then fill in and mail the forms below:
- Annex A – A personal declaration form
- Annex B – Regards information on the provision of gambling
- An application form
However, all the above forms must be completed strictly in Danish. Operators may download English versions from the DGA website as all the necessary documents in Annex A and B are provided in both Danish and English languages otherwise, an authorized translation must be attached.
Licensing Authorities
As a member of EUROMAT [European Gaming and Amusement Industry], Denmark is a party to the rules governing responsible gaming that was first adopted in Maastricht in 2007. The DGA regulates the country’s gaming market in concert with the Ministry of Taxation plus the Consumer Ombudsman:
- TheDanish Gambling Authority is responsible for regulating and monitoring online as well as land-based gambling.
- The Ministry of Taxation is responsible for the inspection of the entities, registration of licensees, and collection of gaming taxes.
- The Danish Consumer Ombudsman’s responsibility is to assist the DGA.
List of Licensees
The Danish Gambling Authority website hosts details of all their licensees, with links provided to the operators. To search for details of the operators who hold licenses, you only need to go to the official website. Details of all active licensees are posted based on the type of gaming license each holds across three criteria; betting and online casino, gaming machines, and poker tournaments.
Dispute Resolution
The DGA doesn’t deal with player complaints or disputes and in case of a dispute with a Danish licensee, players will have to deal with the licensee. However, should the issue remain unsolved, the player can file a complaint with the Danish Consumer Complaints Board. This is where details and conditions will be summarized meticulously. The Danish Gambling Authority cannot mediate disputes between online casino operators and players.
